Terms & Conditions

Welcome to Hygieia Cleaning (“the Company,” “we,” “our,” “us”). These Terms & Conditions (“Terms”) apply to our website, mobile application, and other platforms through which Clients (“you,” “your,” “Customer”) can book cleaning services with independent Cleaners (“Cleaner,” “Contractor”). By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

Definitions

  1. Client/Customer/You: The individual or business that requests cleaning services through our platform.
  2. Cleaner/Contractor: Independent cleaning service providers operating under their own Australian Business Number (ABN).
  3. Booking: A request for cleaning services made by a Client through our platform.

Service Scope

  1. Platform Role: We provide an online marketplace that connects Clients with independent Cleaners. Cleaners are not our employees; they are independent contractors responsible for their own compliance with Australian laws, including holding an ABN and arranging their own insurance (if they choose to do so).
  2. No Guarantee of Availability: We do not guarantee availability of any specific Cleaner or service date. Cleaners may accept or reject any Booking at their discretion.
  3. Scope of Services: Cleaning tasks generally include activities like dusting, vacuuming, wiping surfaces, and mopping floors. Any additional services (e.g., carpet steam cleaning, window washing, oven cleaning) may require extra fees and must be agreed in advance.

Third-Party Responsibility

  1. No Liability for Cleaner Actions: We are not responsible for any damage, loss, or injury (property or otherwise) arising out of actions or omissions by the Cleaner. Any disputes must be resolved directly between the Client and the Cleaner.
  2. Insurance: Cleaners work under their own ABN and may or may not hold insurance. We encourage Clients to verify insurance coverage with their selected Cleaner if it is a concern.
  3. Background Checks: While we may conduct certain checks (police checks, reference checks) on Cleaners, we do not guarantee the completeness, accuracy, or suitability of these checks.

Bookings & Payment

  1. Booking Procedure:
  • Clients request services by submitting a Booking request with details (property type, size, specific tasks, etc.).
  • The system connects the Client’s request with available Cleaners.

2. Service Rates:

  • Rates are typically based on an hourly or flat-fee structure.
  • Additional charges may apply for extra tasks (e.g., deep cleaning, specialised equipment).
  • GST or other applicable taxes may be included in the final price, if applicable.

3. Payment Handling:

  • Payments are made by bank transers.
  • We are not liable for delays or errors caused by payment gateways.

Cancellations & Rescheduling

  1. Cancellation Policy:
  • More than 24 hours before service: You may cancel the Booking without penalty.
  • Less than 24 hours before service: Cancellations incur 50% of the total Booking amount as a fee.
  • No Cancellation Notice (“No-Show”): If no notice is given and the Cleaner arrives at the door, 100% of the total Booking amount is charged.

2. Rescheduling:

  • You may request to reschedule your service at least 24 hours before the scheduled time, subject to Cleaner availability.
  • Rescheduling within 24 hours of the service may be treated as a cancellation and subject to fees, unless agreed otherwise with the Cleaner.

3. Cleaner Cancellations:

  • If a Cleaner cancels, we will make reasonable efforts to find a replacement.
  • We are not liable for any losses arising from a Cleaner’s cancellation, nor do we guarantee a replacement.

Service Conditions & Client Obligations

  1. Accurate Information: Provide honest and complete information about the property (size, condition, specific tasks). Inaccurate descriptions may result in extra fees or cancellation.
  2. Access to Property: Ensure the Cleaner has safe and unobstructed access (correct keys, codes, etc.). If the Cleaner cannot gain access, the Client may be charged the full Booking fee.
  3. Secure and Hazard-Free Environment:
  • You are responsible for ensuring that your property is free from hazards that could endanger the Cleaner or damage equipment.
  • Disclose any known hazards or special conditions (e.g., fragile items, hazardous materials, etc.).

4. Pets: If pets are on the premises, the Client is responsible for securing them and disclosing any pet-related requirements (e.g., allergies, aggression, etc.).

5. Special Requests: Any special cleaning tasks (e.g., removing mould, heavy stains, cleaning high or difficult-to-reach areas) must be communicated in advance to verify feasibility and pricing.

Provision of Cleaning Supplies & Equipment

  1. By Default: Cleaners may provide their own basic cleaning supplies (e.g., detergents, cloths) and equipment (e.g., vacuum, mop), but this can vary by Cleaner.
  2. Client-Supplied Products: If the Client requires specific products, the Client must inform the Cleaner in advance. If additional costs are involved, the Client is responsible for covering them.
  3. Allergies or Sensitivities: Clients should notify the Cleaner in advance of any chemical or product sensitivities.

Damages, Breakages & Limitations

  1. Reporting Damages: Any damage or breakage caused by the Cleaner should be reported to both the Cleaner and our team within 24 hours after the service.
  2. No Liability: We are a third-party platform and do not accept liability for damages. Any claim for compensation must be pursued directly with the Cleaner.
  3. Fragile or Irreplaceable Items: The Client should store or secure valuables, heirlooms, jewellery, or fragile items. The Cleaner may refuse to handle extremely fragile or expensive items unless explicitly agreed.
  4. Wear & Tear: Normal wear and tear on surfaces and fixtures (e.g., minor scuffing, loosening of knobs) is not considered damage.
  5. Fair Use of Equipment: The Client agrees not to hold the Cleaner responsible for any pre-existing damage or malfunction in the Client’s home or its fixtures.

Disputes & Refunds

  1. Direct Resolution: The Client should first contact the Cleaner to resolve service-related issues. We may assist with communication but do not mediate or arbitrate disputes.
  2. Refunds:
  • Since each Cleaner is an independent contractor, refunds are subject to the Cleaner’s policies.
  • We do not process refunds on behalf of Cleaners.
  1. Australian Consumer Law: Nothing in these Terms excludes any rights or remedies you may have under the Australian Consumer Law or other local regulations.

Our Liability

  1. Disclaimer of Warranties: Services are provided “as is” and “as available.” We make no warranty as to the suitability, reliability, or timeliness of any Cleaner or service.
  2. Limitation of Liability: To the fullest extent permitted by law, we disclaim liability for any direct, indirect, incidental, consequential, or special damages arising from or connected with the Services, including the actions of a Cleaner.
  3. Force Majeure: We are not liable for any failure to fulfil obligations due to events beyond our reasonable control (e.g., natural disasters, strikes, government orders, pandemics).

Privacy & Data Protection

Collection of Information: We collect personal information (e.g., name, address, contact info) from Clients and Cleaners to facilitate Bookings. By using our Services, you consent to the collection, use, and disclosure of your information in accordance with our Privacy Policy.

Intellectual Property

  1. Website Content: All content, trademarks, logos, and materials on our platform are owned or licensed by us and are protected by intellectual property laws.
  2. Limited Licence: You are granted a limited, non-exclusive licence to access and use the Services for personal or internal business use only. Commercial exploitation is not permitted without written permission.

Indemnification

You agree to indemnify and hold harmless Hygieia Cleaning, its affiliates, officers, directors, employees, and agents from any claim or demand arising out of your breach of these Terms, your improper use of our Services, or any dispute with a Cleaner.

Amendments to Terms

We reserve the right to modify or replace these Terms at any time. Any changes will be posted on our website, and continued use of the Services after such postings constitutes acceptance of the revised Terms.

Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts in the specific State/Territory of the location of the service.

Severability

If any provision of these Terms is found invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, along with our Privacy Policy and any other policies or additional terms referenced herein, constitute the entire agreement between you and Hygieia Cleaning concerning your access to and use of our Services.
